Protecting Trade Secrets and Confidential Information

Protecting Trade Secrets and Confidential Information

We can advise on the right systems to protect your valuable confidential information and trade secrets, not only when dealing with your internal processes and key staff (e.g. through non-disclosure agreements and provisions in employment contracts) but also during negotiations with third parties, or dealings with suppliers. Getting the right advice and taking swift action is key to protecting secrets.

Example:

Our client, a world leader in the design, manufacture and support of industrial turbochargers, became aware that a former employee had taken copies of confidential documents including specifications and technical drawings. These documents are highly valuable trade secrets. We assisted our client in establishing the extent of the breach by the former employee of his confidentiality obligations, obtaining a series of disclosure orders and injunctions prohibiting further use of our client’s trade secrets. We also approached and questioned third parties who may have had our client’s confidential information in their possession. This has culminated in the issue of High Court proceedings for breach of confidence and infringement of intellectual property rights against a number of defendants.
